Disclaimer and Waiver (Adult)

Bugweed’s Limited (“Bugweed’s”).

am participating in a course, activity or event (“course”) provided by Bugweed’s which may involve (amongst others) the use of the following equipment:

  • an electric sewing machine;
  • hand needles;
  • scissors;
  • safety pins;
  • safety clips;
  • rotary cutters;
  • craft knives;
  • electric iron;
  • knitting needles;
  • crochet hooks; and/or
  • miscellaneous craft tools and accessories.

What Bugweed’s will provide

Bugweed’s shall provide all of the equipment required to participate in the course, activity or event except where otherwise stated.  The equipment provided shall be fit for the purpose for which it is designed and the nature of the course, activity or event.  Bugweed’s will maintain it regularly and ensure that in its use in the provision of the course, activity or event to me it is suitable for the needs of a typical user.  Where it is necessary and appropriate to do so, I will be shown how to use the equipment properly and therefore safely.

My promise to you

I appreciate that the equipment used to deliver the course to me has the ability to cause me personal injury; as such I represent and declare to Bugweed’s that:

  • I do not have a medical condition that would, to my best knowledge and belief, prevent me from participating in the course, activity or event. Where such medical conditions are known, they are listed below.  Bugweed’s may prevent me from participating in a course, activity or event in circumstances where a pre-disclosed medical condition has the potential for causing me harm or injury should I be allowed to participate in it;
  • I will at all times act in accordance with the instructions of the course, activity or event instructor or facilitator;
  • I will not act in a manner that is inappropriate when participating in the course, activity or event;
  • I will not and have not consumed any alcohol or illegal substance in the 10 hours prior to attending at the course, activity or event nor will I throughout the duration of the course, activity or event;
  • I will not and have not consumed any form of medicine which may affect or impair my ability to participate fully and correctly in the course, activity or event or use any equipment provided by Bugweed’s safely;
  • in circumstances where I provide my own equipment, it is fit for the purpose of the course, activity or event and I am fully conversant with its operating instructions; and
  • I will make the instructor aware if I feel unwell or if I become aware of any circumstance which may prevent me from taking part in the course, activity or event safely.

I understand and agree that Bugweed’s may at any time, at its sole discretion, ask that I cease from taking part in the course, activity or event in circumstances where it is of the opinion that I fail to behave in accordance with this declaration or where further participation could result in harm to either myself or others.  In such circumstances, I shall not be entitled to a refund of the price paid to Bugweed’s for entry onto the course, or participation in the event or activity.

Waiver

I understand that participation in the course, activity or event and the use of the equipment highlighted above, when used correctly, should not cause harm.  However, on occasion, accidents happen.  Subject to the terms above, except in circumstances where Bugweed’s has acted negligently, I agree to voluntarily release, waive and discharge any claim that I may have against Bugweed’s in the delivery of the course, activity or event to me.

I declare that I have read and understood the contents of this declaration and that the contents of it are accurate and not misleading.

Bugweed’s Limited (Bugweed’s)

agree that he/she shall participate in (and is capable of participating in, without causing injury to him/herself or others) a course, activity or event (“activity”) provided by Bugweed’s which may involve (amongst others) the use of the following equipment:

  • an electric sewing machine;
  • hand needles;
  • scissors;
  • safety pins;
  • safety clips;
  • rotary cutters;
  • craft knives;
  • electric iron;
  • knitting needles;
  • crochet hooks; and/or
  • miscellaneous craft tools and accessories.

What Bugweed’s will provide

Bugweed’s shall provide all of the equipment required to participate in the activity except where otherwise stated.  The equipment provided shall be fit for the purpose for which it is designed and the nature of the course, activity or event.  Bugweed’s will maintain the equipment.  Bugweed’s cannot provide specific equipment for each child, therefore the equipment shall be fit for use by the general age range of those participating in the activity.  Where it is necessary and appropriate to do so, the child participating in the activity will be shown how to use the equipment properly and, therefore, safely and will be supervised.

My promise to you

I appreciate that the equipment used to deliver the activity to the child participating in it has the ability to cause him/her personal injury; as such I represent and declare to Bugweed’s that:

  • the child participating in the activity does not have a medical condition that would prevent him/her from participating in it. Where such medical conditions are known they are listed below.  Bugweed’s may prevent my child from participating in the activity in circumstances where a pre-disclosed medical condition has the potential for causing injury or harm to either him/her or others should s/he be allowed to participate in it;
  • the child participating in the activity has not consumed any form of medicine (or other substance) which may affect his/her ability to fully and correctly participate in the activity or use any equipment provided by Bugweed’s; and
  • I have discussed the nature of the activity and the potential for harm with the child participating in the activity in a language that s/he understood. I confirm that I am satisfied that the child participating is aware of the inherent dangers that participating in the activity poses.  I undertake that s/he will behave accordingly.

I understand and agree that Bugweed’s may at any time, at its sole discretion, ask that the child participating in the activity ceases from taking part in it in circumstances where s/he fails to behave in accordance with this declaration or Bugweed’s is of the opinion that further participation could result in harm to either him/herself or others.  In such circumstances I shall not be entitled to a refund of the price paid to Bugweed’s for entry onto, or the participation in, the activity..

Waiver

I understand that participation in the activity and the use of the equipment highlighted above, when used correctly, should not cause harm. However, on occasion accidents happen. Subject to the terms above, except in circumstances where Bugweed’s has acted negligently, I (on behalf of the child participating in the activity) agree to voluntarily release, waive and discharge any claim that I or such child may have against Bugweed’s in the delivery of the course, activity or event to him/her.

I declare that I have read and understood the contents of this declaration and that the contents of it are accurate and not misleading and that I have parental responsibility for the child participating in the activity
